4.2 Payment is taken when you place your Order.

4.3 We will email you to acknowledge receipt of your Order. This acknowledgement does not constitute acceptance of your Order.

4.4 Your Order is accepted, and the Contract is formed, when we send you the Dispatch Confirmation.

4.5 We may decline an Order at any time before the Contract is formed, including where a Product is unavailable or has been incorrectly priced. If we decline your Order, we will notify you and refund the full amount paid.

5. Prices, taxes and payment

5.1 Prices are as shown on the Website at the time of your Order. Prices for delivery within the United Kingdom include VAT.

5.2 Delivery charges, and any taxes or duties collected at checkout, are shown before payment is made.

5.3 Orders delivered outside the United Kingdom may be subject to import duties and local taxes. Where these are not collected at checkout, you are responsible for paying them. We have no control over these charges.

5.4 We may change our prices from time to time. Price changes do not affect Orders already placed.

5.5 If we discover an error in the price of a Product you have ordered, we will notify you, and you may either proceed with the Order at the correct price or cancel it for a full refund. Where the error is obvious and could reasonably have been recognised by you as a mistake, we are not obliged to supply the Product at the incorrect price.

5.6 Promotions and discount codes are subject to the terms stated at the time of the promotion. Unless otherwise stated, discount codes cannot be used on bundles, only one discount code can be used per Order, and codes cannot be applied after an Order has been placed. Where promotion terms conflict with these Terms, the promotion terms will apply.

6. Delivery

6.1 We deliver to the countries available at checkout.

6.2 Delivery options, charges and estimated delivery times are shown at checkout and in our Shipping Policy. Delivery times are estimates and are not guaranteed.

7.1 You may return Products in accordance with our Refund Policy. The Refund Policy forms part of these Terms.

7.2 For hygiene reasons, women's and girls' swimwear can only be returned with the protective hygiene seal intact, unless the item is faulty, as set out in our Refund Policy.

7.3 The Refund Policy is in addition to, and does not affect, your statutory rights.

8. Faulty Products and statutory rights

8.1 We are under a legal duty to supply Products that are of satisfactory quality, fit for purpose and as described.

8.2 Under the Consumer Rights Act 2015, if a Product is faulty you are entitled to reject it within 30 days of delivery for a full refund. After that period, you are entitled to a repair or replacement and, in certain circumstances, a refund or price reduction.

8.3 If you believe a Product is faulty, you should contact us at enquiries@maruswim.com. We may ask you to return the Product so that we can examine it. We will bear the cost of returning a faulty Product and will refund any delivery charges paid for it.

8.4 Normal wear and tear, and damage caused by misuse, accidents or not following the care instructions, are not faults.

8.5 Nothing in these Terms affects your statutory rights.
